Software License
This license is a legal agreement between you and NetRaising for the use of eeSiteKit Software (the “Software”). By installing and using eeSiteKit, or its components on your server, you agree to the following terms and conditions. Such agreement is either on your own behalf or on behalf of any corporate entity which employs you or which you represent (‘Corporate Licensee’). In this Agreement, ‘you’ includes both the reader and any Corporate Licensee.
PERMITTED USE
You may install and use eeSiteKit as many times as you like.
RESTRICTIONS
Unless you have been granted prior, written consent from NetRaising, you may not:
- Reproduce, distribute, or resell the Software, or portions thereof, to any third party.
- Publish the Software code in whole or in part in any electronic or print media.
- Sell, rent, lease, assign, or sublet the Software or portions thereof.
- Grant rights to any other person related to this software.
- Use the Software in violation of any U.S. or international law or regulation.
DOWNLOAD ACCESS
When you purchase eeSiteKit, or the Template Installer Script for ExpressionEngine, you will have access to the downloads area of our website for 180 days. Beyond 180 days you will need to purchase download access for each product again.
DISPLAY OF COPYRIGHT NOTICES
All copyright and proprietary notices displayed within the code must remain intact. It is not necessary to display these notices on any public viewable pages of your website(s), or in any public viewable code.
ACKNOWLEDGEMENT
You are encouraged to give credit to eeSiteKit in any websites you launch where you’ve used eeSiteKit. If you would like to remove the eeSiteKit link from the bottom of your site, you’ll find the code in the core/.footer template of the control panel.
MAKING COPIES
You may make copies of the Software for backup purposes and testing on a test host, providing the backup copies will never will be accessed by the general public, and that you reproduce the Software in its original form and with all proprietary notices on any backup or testing copies.
SOFTWARE MODIFICATION
You may alter, modify, or extend the Software for your own use, or commission a third party to perform modifications for you, but you may not resell, redistribute or transfer the modified or derivative version without prior written consent from NetRaising. Components from the Software may not be extracted and used in other programs or publications without prior written consent from NetRaising.
TECHNICAL SUPPORT
Technical support is available only through the Online Support Forums at eeSiteKit.com. NetRaising does not provide direct email or phone support. No representations or guarantees are made regarding the response time in which support questions are answered. Technical support is only available to the original purchaser of the Software.
REFUNDS
NetRaising does not issue refunds once a transaction has been completed.
INDEMNITY
You agree to indemnify and hold harmless NetRaising for any third-party claims, actions or suits, as well as any related expenses, liabilities, damages, settlements or fees arising from your use or misuse of the Software, or a violation of any terms of this license.
DISCLAIMER OF WARRANTY
THE SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD “AS IS” AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. NETRAISING DOES NOT WARRANT THAT THE SOFTWARE OR ANY RELATED SERVICE WILL ALWAYS BE AVAILABLE.
LIMITATION OF LIABILITY
NETRAISING IS NOT LIABLE FOR THE CONTENT OF ANY SITE POWERED BY THE SOFTWARE.YOU ASSUME THE ENTIRE RISK ASSOCIATED WITH THE INSTALLATION AND USE OF THE SOFTWARE. ANY LIABILITY OF NETRAISING WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE PRICE.
YOU ASSUME ALL RISK ASSOCIATED WITH THE INSTALLATION AND USE OF THE SOFTWARE. IN NO EVENT SHALL NETRAISING BE LIABLE FOR CLAIMS, DAMAGES OR OTHER LIABILITY ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE. YOU ARE SOLELY RESPONSIBLE FOR DETERMINING THE APPROPRIATENESS OF USE AND ASSUME ALL RISKS ASSOCIATED WITH ITS USE, INCLUDING BUT NOT LIMITED TO THE RISKS OF PROGRAM ERRORS, DAMAGE TO EQUIPMENT, LOSS OF DATA OR SOFTWARE PROGRAMS, OR UNAVAILABILITY OR INTERRUPTION OF OPERATIONS. IN NO EVENT WILL NETRAISING BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS, LOSS OF DATA OR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE SUCH SOFTWARE, EVEN IF NETRAISING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
GENERAL
This Agreement constitutes the complete statement of the agreement between you and NetRaising, and supersedes all representations, understandings or prior agreements between you and NetRaising.
NetRaising reserves the right to alter this agreement at any time, for any reason, without notice.
